Cannabis is legal in over 10 states for recreational purposes and 33 states for medicinal purposes in the US


Cannabis use for recreational and even medical purpose is banned in the United States at the federal level by Controlled Substance Act,1970. Cannabis is classified as a Schedule 1 substance under the Controlled Substances Act. Schedule 1 substances are most likely abused and have no medical usage.

Despite being illegal federally, some states and territories have made conflicting rules on recreational and medical use of cannabis.

  • The medical use of cannabis is legal with doctor's recommendation in 33 states along with the District of Columbia, and the territories of Guam, Puerto Rico, the Northern Mariana Islands, and U.S. Virgin Islands.
  • The recreational use of cannabis is legal in 10 states namely Alaska, California, Colorado, Maine, Massachusetts, Michigan, Nevada, Oregon, Vermont, Washington, the District of Columbia, and the Northern Mariana Islands.
  • 13 states namely Connecticut, Delaware, Nebraska, Mississippi, North Carolina, Ohio, New York, Rhode Islands, New Hampshire, Missouri, Minnesota, Maryland and Illinois have partially or fully decriminalized cannabis.
  • Fourteen other states have laws that limit THC content, for the sole purpose of allowing access to products that are rich in cannabidiol (CBD), which is a non-psychoactive component of cannabis.

Some facts you should know.

  1. The commercial distribution of cannabis is allowed in all jurisdictions where cannabis have been legalized, except Vermont and the District of Columbia.
  2. The minimum age limit for possession, transportation, and processing of cannabis is 21 years in all states.
  3. The National Centre for Natural Products Research in Oxford, Mississippi is the only facility in the United States that is federally licensed by the Drug Enforcement Administration to cultivate cannabis for scientific research.
  4. On December 6, 2012, Washington became the first U.S. state to legalize recreational use of marijuana.
  5. Guam was the first United States Territory to legalize medical marijuana, in 2014.
  6. The state of Maine has the highest cannabis possession and transportation limit of 2.5Oz.

Cannabis dispensaries are a local government regulated physical location, typically inside a retail storefront or office building, in which a person can purchase cannabis and/or cannabis related items for medical or recreational use. Around 23 states regulate some form of medical cannabis sales despite federal laws. As of 2016, 17 of those states namely Arizona, California, Colorado, Connecticut, Delaware, Illinois, Maine, Michigan, Montana, Nevada, New Jersey, New Mexico, New York, Oregon, Rhode Island, Washington, and Washington, D.C. have at least one medical marijuana dispensary with varying product laws.
